1. Acceptance of Terms

Welcome to Termometer! These Terms of Service ("Terms") constitute a legal agreement between you and Nicholas Faylor ("we," "us," or "our") governing your use of the Termometer word association game, including our website and mobile applications (collectively, the "Service").

By creating an account, accessing, or using Termometer, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

2. Eligibility

You must be at least 13 years of age to use Termometer. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you confirm that you have obtained permission from a parent or legal guardian to use the Service.

3. Account Registration and Security

3.1 Account Creation To access certain features of Termometer, you must create an account using Clerk authentication. You agree to provide accurate and complete information during registration.

3.2 Account Security You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us at nick@termometer.app of any unauthorized use of your account.

3.3 Account Termination We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

4. Description of Service

Termometer is a word association game where users play with pre-set word associations to test their vocabulary and reasoning skills. The Service includes:

  • Free Features: Daily word challenge and basic game mode
  • Premium Subscription: Access to all game modes for $2.99 per month
  • Global Leaderboard: View rankings of other players

5. Premium Subscription

5.1 Subscription Terms The premium subscription provides unlimited access to all game modes for $2.99 per month. Your subscription will automatically renew each month unless cancelled.

5.2 Payment Processing All subscription payments are processed through RevenueCat and your device's app store (Apple App Store or Google Play Store). By subscribing, you agree to the payment terms of your respective app store.

5.3 No Free Trial Premium subscriptions do not include a free trial period. You will be charged immediately upon subscribing.

5.4 Cancellation You may cancel your subscription at any time through your device's app store settings. Cancellation will take effect at the end of your current billing period.

5.5 No Refunds All subscription payments are final and non-refundable. We do not provide refunds or credits for partial subscription periods. This policy is in addition to any refund policies enforced by Apple or Google through their respective app stores.

5.6 Price Changes We reserve the right to change subscription pricing with at least 30 days' notice. Price changes will take effect at the start of your next billing cycle after the notice period.

6. Acceptable Use Policy

You agree NOT to:

  • Cheat, exploit bugs, or use unauthorized third-party software to gain unfair advantages
  • Attempt to hack, reverse engineer, or compromise the security of the Service
  • Create multiple accounts to manipulate leaderboards or game statistics
  • Harass, abuse, or harm other users in any way
  • Use the Service for any illegal or unauthorized purpose
  • Attempt to access other users' accounts or data
  • Submit false or misleading information to the Service
  • Use automated scripts, bots, or tools to interact with the Service
  • Engage in any activity that interferes with or disrupts the Service

Violation of this Acceptable Use Policy may result in immediate account termination.

7. Leaderboards and Competitive Features

7.1 Fair Play All leaderboard rankings must be achieved through legitimate gameplay. We reserve the right to remove scores or rankings that we determine were obtained through cheating or exploitation.

7.2 Public Display By participating in leaderboards, you acknowledge that your username and scores may be publicly displayed to other users.

7.3 No Guarantees We do not guarantee the accuracy or availability of leaderboards and may reset, modify, or remove leaderboard data at any time.

8. Intellectual Property Rights

8.1 Our Content All content included in the Service, including text, graphics, logos, game mechanics, word lists, software, and designs, is the property of Nicholas Faylor or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

8.2 Limited License We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

8.3 Trademark "Termometer" and associated logos are trademarks of Nicholas Faylor. You may not use these trademarks without our prior written permission.

9. Privacy and Data Collection

9.1 Data Collection We collect and process the following information:

  • Email address (via Clerk authentication)
  • Gameplay statistics and performance data
  • Device information and technical data
  • Any additional data collected through Clerk's authentication services

9.2 Data Usage We use collected data to:

  • Operate and maintain the Service
  • Process subscriptions and transactions
  • Display leaderboard rankings
  • Improve game features and user experience
  • Communicate with you about the Service

9.3 Data Storage User data is stored securely using Clerk authentication services databases.

9.4 No Data Sharing or Sale We do not sell, rent, or share your personal information with third parties for their marketing purposes. We may share data with service providers solely for the purpose of operating the Service.

9.5 Account Data Retention At this time, users cannot independently delete their accounts. If you wish to delete your account and associated data, please contact us at nick@termometer.app, and we will process your request.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • The results obtained from using the Service will be accurate or reliable
  • Any errors in the Service will be corrected
  • The Service will meet your specific requirements

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NICHOLAS FAYLOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, or other harmful code that may be transmitted through the Service
  • Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless Nicholas Faylor from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of any applicable laws or regulations

13. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, for any reason. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this document. Material changes will be communicated to users via email or through a prominent notice in the Service.

Your continued use of the Service after changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Service.

15. Governing Law and Dispute Resolution

15.1 Governing Law These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

15.2 Jurisdiction You agree that any legal action or proceeding arising out of or relating to these Terms or the Service shall be filed exclusively in the state or federal courts located in California, and you hereby consent and submit to the personal jurisdiction of such courts.

15.3 Informal Resolution Before filing any formal legal action, you agree to first contact us at nick@termometer.app to attempt to resolve the dispute informally.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be deemed modified to the extent necessary to make it valid and enforceable while preserving its intent.

17. Entire Agreement

These Terms constitute the entire agreement between you and Nicholas Faylor regarding the use of the Service and supersede any prior agreements between you and us relating to your use of the Service.

18. No Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
